I recieved a phone call from a number AT WORK that told me I was being taken to court by this man claiming to work for the law firm and that I had to be in court tomorrow. This is not right, and if it was true, no documents have been mailed.
Okay, so I've received 4 calls from this number. Two to my cellphone and two to my work number. None of which I responded to, which means I have 4 voicemails. Two came in on Monday, and then two today.
They called my cellphone and left a msg, and then called my work phone immediately thereafter, in both cases, and left a msg (I was sitting right here monitoring but not answering because caller ID displayed as "anonymous" or "private number" on cell, and just at "0" on work phone. I do owe a payday loan, but they were so rude and nasty with me when I tried to straighten it out (two weeks after the incident) that I said 'screw it'. For a long time afterwards (the original transaction was approx May 2008) they'd send me emails on a regular basis (at my job). This lasted for approx 6 months. A couple of times, I received a 'settlement' letter stating they'd settle for the amount borrowed (I suppose they were going to eat the fee). Every now and then, I still get promotions from them stating I'm pre approved for a PDL. Then sometime around January I started getting these calls from some "law firm". I never returned the calls. They continued leaving msgs for a couple of months until they finally gave up. Then another law firm starting calling and leaving msgs at work and on my cellphone. Funny thing about this one is, they'd called and left msg on my cellphone, then called my job right afterward. Cellphone msg stated I had until Friday at 2pm or the att would be filing paperwork in court. Because my work voicemail stated I was on vacation thru Friday, the msg left at my job stated "since you are on vacation, I will ask the atty to hold off filing the paperwork until Monday, but you must contact me on Monday or I won't be able to do anything to help you." I didn't call back, so they called me again that Monday and left a "by 5pm today" deadline. I didn't call back, so I got another msg on Wednesday giving me a 2pm on Friday deadline. They finally stopped calling with the threats and I guess they've now sold the debt to this company. I'm willing to pay..but only the amount I borrowed. They can sell this debt over and over again and until someone sends me something in writing, prior to me paying, or sends me a judgment from the courts, I won't be dealing with these nasty, greedy folks.
BTW- Most of the internet PDL company's aren't licensed to practice in the state of Calif (I didn't know that when I started to deal with them). If any company is offering you a loan for more than $300 and/or asking more than $45 return on that money for a two week period, they probably fall under those not licensed to practice in Calif. Sorry about the length of this msg. I didn't intend for it to be so long. I still didn't get to inform you all of the msg that I received from this new company. It was scripted (all four times, exactly the same wording). You'll love this. More later.
I wanted to post the call I received as best I could understand what this woman was saying so that you all could hear what I had to hear four (4) separate times. The first two times it was quite a bit unnerving. The threats!-(it simply can't be legal to say that to someone... and they were aware that they were being taped because they left it on my voicemail...4 times!) Anyway, I tried to transcribe it as best I could. Here goes...
“This msg is intended for….
???? …as soon as you receive this msg, I need you or your atty of record to return my call. The issue at hand is extremely time sensitive. My name is Anna Wilson and my callback number is … Do not disregard this msg and rtn the call.
And now, if you don’t return the call and I don’t hear from your atty either, the only thing I can do is wish you good luck as the situation unfolds on you.”
However, when they called back three days later the msg left have one more sentence appended - “And best of luck for your ???”
Because of the extremely heavy accent, I don’t know how the best of luck sentence ended though I played that msg over and over at least 5 times. I thought she’d said “and best of luck for your children”. I was livid! And I almost called them back, but they would have denied saying that, and I would have been extremely frustrated trying to communicate with this woman who had a very heavy accent and who was reading from a script and probably couldn’t deviate from it.
These people should get their stuff together and at least be consistent. They sound like a bunch of rude, bumbling idiots (not because of the accent) reading word for word from a script. However, the script is intended to frighten you into calling them immediately. I shall not be moved. They need to sell the debt back to the originator and deal with me like civil folks should. Then we’ll both be happy – they’ll be paid and I will be rid of them forever.
I also received call from the above number 5/09. I have since received a call on 6/3/10 and 6/8/10 from number 760-514-0172 and 352-390-2183. Thanks to all that have posted a comment. I was very upset and scared that I would lose my job because of their claims.
This whole thing is a scam! These guys are not in the U.S. nor are they able to take legal action on us. An Indian "officer" by the name of Tom called not telling me who i owed, why i owed it or anything but rather making sure i know that there is a legal financial issue tied to my SS number. He said I can get a settlement for 825. I said no way and he said well tell me what you can pay. I said im at work ill call you back so that i could contact my lawyer. He started demanding that i tell him how much i can pay. Eventually he said he'll call back in one hour.
I called back with my lawyer on the line and she spoke to him. When she asked what is your address He said Dallas Texas.......she asked him to be more specific and he said, "look mam, i dont have to discuss anything with you!" screaming. She went on to tell him his legal right as a so called debt collector and he kept screaming at her and said "well i will call his manager at work!" lol.
DO NOT GIVE THESE GUYS ANY INFO, NOR ANY PAYMENT!! THEY ARE AN ILLEGAL OPERATION. MY LAWYER HAS CONFIRMED THAT THEY CANNOT ARREST ANYONE NOR ARE THEY LEGAL ALLOWED TO REPEATEDLY CALL US. ALSO, THE LAW STATES THAT WITHIN 5 DAYS OF A CALL FROM A DEBT COLLECTOR THEY HAVE TO PROVIDED IN WRITING THE DETAILS OF YOUR DEBT. HANG UP ON THEM AND TELL YOUR COMPANIES SECRETARY OR YOUR MANAGER YOU ARE BEING SCAMMED AND THAT ANY CALLS FROM INDIANS FOR YOU SHOULD BE IGNORED.
