After telling them that this is a work number and calls of this nature can not be answered at this location and number and after leaving a voicemail at 7:15am then calls 4 more times!? Tell me this follows the fair debt collection act?
I have a Cellphone and kip recieving phonecalls asking for JOANNE MANCINO OR (MANACINO,MANANCHINO). from NY .
I don't know how to spell the last name but it is annoying .. don't know how she , but apparently she has bad credit .
These are bottom feeder collection companys that buy bulk old debt for pennies on the dollar. The continually violate the Fair Debt Collection Act and use an automated system to place calls. If you are receiving calls from them please be aware that they cannot threaten you, mistreat you, or continually call you. They cannot send the police after you. They only thing they can do if file for a judgement against you in your county court, but that is highly unlikely as they have thousands of files and that is just not physically possible for them to send company reps to all the different counties in the areas they collect. Also, check you state's statue of limitations. There are laws protecting you from someone trying to collect on very old debt and that limitation starts from the date of last activity on the account. If you want to settle a valid collection on yourself, try offering them a settlement, say 25 cents on the dollar. If they won't deal with you and become belligerent on the phone let them know that you are willing to work with them, but if they continue to act like an idiot, they will hear dial tone. Key rule...just stand your ground and don't be intimidated. They are trained to make you get emotional and that's what they want. So don't play the game and remain completely business-like.
First off let me start by saying if people paid their bills to companies such as GM and Ally bank these people would not be getting phone calls. These of course are just two of the many companies that this Collection company works for. They DO NOT buy the old debt, they are contracted by numerous national companies to work for them and collect these debts. They are within the laws of The FDCA and while they do use an automated system, your number would not be in there if you or the previous owner of that phone number did not own money to a company such as GM financing. They do not try to collect a debt that is more then 7 years old unless you or the person that owned that phone number before you made an agreement with them. Then the 7 years starts all over again. They do actually have thousand of files and again these are not something they buy these are files that national companies have given them and they are contracted to collect for these national companies. Yes there are bad companies out there and bad collectors from every collection agancy, this does not mean they are all bad or breaking laws. They are often working with invalid information or older information. Since people move and change their phone numbers they may simply have the wrong information. Yes I do know several collectors that work for a legitimate company that is contracted to national car companies and banks. They are doing their job because people renig on loans, credit card payments and such. If people paid thier bills and did not overspend on things they cannot actually afford these people would not be calling.
