Just received a call at work from a Susan Stine.  Can't remember the supposed law firm she said she was with.  But then again she also said they were a debt collector.  They are handling a case for St. Armands.  A payday loan company.  Claiming all the usual.  I defaulted on the loan and check fraud.  There is no check fraud when it is online and they were getting payments.  I simply got to a point where I couldn't afford the payments any more.  Told her to send me something in writing to verify that they are who they say they are and then I heard someone in the background telling her to tell me that they had already sent me a notice.  I told her that I could hear them telling her what to say and she said it was her supervisor.  I then told her since she said they were a debt collector that when I requested them to send me something in writing that they were to do so within 5 days of my requesting it and to cease contact until then.  As I was hanging up I could hear a guy starting to get on the line.  Guess he thought he was going to be able to bully and scare me as most try to do.  Unfortunately, I got myself in way over my head with these kind of payday loans and had to file bankruptcy years ago.  I learned the hard way and also had to read up on my rights under the FDCPA.  When I start stating the rules that they are supposed to follow, I usually get told how stupid I am that they were trained on the rules.  Yeah their own rules.  Never agree to anything over the phone or by email.  Get their # and mailing address.  Make them prove it.  That is how it is supposed to go.  Them prove it not you.  Also everywhere you read,  you will see where the most scam calls come from area code 202.

} when I requested them to send me something in writing that they were to do so within 5 days

The 'five day' rule doesn't work that way. It's triggered by an action from the collection agency (DCA), not the consumer. From Day One the DCA must provide the basics of its debt claim and certain disclosures regarding one's ability to dispute them. If those disclosures are not made in the first contact, and I'm pretty sure they never are, the DCA has five days to mail a paper "G-letter". The consumer should not have to request this. Failure to mail that letter alone violates the FDCPA.

If you want your debt validated, that's what you'll have to request on paper within a month of receiving the G-letter. Your validation demand triggers yet more protective provisions of the Act, such as silencing the DCA forever until it complies with your request. I'm sure you've read all this yourself, but the details can be confusing to even experienced consumer warriors. You're quite correct that there's a big difference between laws on the books and the twisted internal rules followed by their violators. The last thing a thug debt collector wants is a paper trail and an informed person who marks one.

Wrong or right on the 5 day thing, they still haven't sent anything.  Not surprised.  They called me at work again today.  I believe the lady calling me must be new.  When ever I would say anything about sending me something in writing by the us mail and quit calling me at work there would be a short silence before she would say anything.  Told her that I had already talked to them once and not to call me again.  She said it would be quicker if they could send it to me by email.  Told her no that regulations say it has to be by us mail.  Then she wanted my address.  Told her she should have all of that info if they do have a file on me.  I then hung up.
