I spoke with an officer this evening on the matter. The officer had 17 years in criminal investigations. I went through the same scenario. I was told I had a "pending warrant", "My arrest was imminent if not handled right here and now" "There is no such thing" the officer replies. There is either a warrant, or not. He ran my record, and there was nothing showing any kind of action against me.
In order for it to be "FRAUD" they need to prove in a court of law that it is fraud. Creditors, collectors, and even a "CRIMINAL INVESTIGATOR" , they can claim anything they want to, but it cannot issue an arrest against a consumer simply on their claims. There is the whole legal process ie. Notices, summons, courtroom appearance! What would that do to the state of the nation if they placed warrants on all bad checks, or claims of check fraud?
It also sounded to the Officer that this guy has found a loophole in the system, and he is using boiler room tactics to obtain collection benefits for companies. . . when you think about it. . . "need to handle this right now to avoid the issuing warrant" He is still trying to "COLLECT" funds.
GiG, you and Carl need to research about investigation firms before giving out advice. They are not collectors, they do not have FDCPA guidelines, because they find people for criminal matters and are not trying to collect a debt. I wish I would have did my research before I was arrested. I chose to listen to Carl and now I'm in a bad situation and Carl will have a great Christmas, while I'm worried about this trial for this old bad check crap!!!!!!!
