UPDATE: I took the call from them at 8 a.m. this morning and played into their game to get as much info as possible. They are reading from scripts, and if you ask them anything that goes off-script, they transfer you. I spoke to 3 people this morning: Louis Wilson, Heather Lawson and Ben Foster. In looking up Heather Lawson, I see complaints about this scam dating back to 2006!! Why can't we stop this?! This personal information should not be released when people apply for a payday loan.
When I asked for an address, they gave me 42 Broadway 5th Floor NY, NY 10004, and said they are the DCA Law Firm - Department of Corporate Affairs. In actuality, there IS a DCA at this address, but it is the NYC Department of Consumer Affairs.
When "Ben Foster" no longer felt like making up stories to answer my questions (such as "If this was in collections, why haven't I received a written notice within 5 days of initial contact, as per the law under the Fair Debt Collection Practices Act (FDCPA)?"), he said they would go ahead and process my file and we could deal with it at the courthouse on Monday. I sweetly answered "Oh yes, let's go ahead and do that." He was a bit surprised and then asked for my attorney's info, so I said "Yes, he definitely wants to talk to you" and gave him the info. Then I told him that we were aware this is a scam, that I have already reported him to the FTC and FBI, and that all calls were being recorded. I told him to never ever call here again or he would be the one showing up at the courthouse. I hung up. No callback yet. I am sick to my stomach with what these people are doing to scared, financially-strapped people.
i had a call myself today well more like 20 from 941 - 244- 3613 it was a m indian guy or somthing very hard to understand but he told me they had an affidavid for me and i was being sued by american payday loans for like 5000 lol well if i had 5000 i sure as hell wouldnt be drivin a 97 chevy prism lol id be shoppin and i told the guy i never recived a loan and that i hadent even had a job in over a year and he got mean then i told him id have to contact the police because there must be some fraud going on somewhere here and he hung up so i called back asking him the questions this time he got even madder told me not to worry that they would be coming to my front door in the morning to arrest me for theft and like 2 other charges he said they were filed with my local court house so i ask whats my court house he didnt even know lol then ask me for my info i said well if this is legitr shouldnt u have it but he did have my email address my last 4 of my social and my birthdate so im kinda scared because ive never ever had a loan or anything so how does he have my info is this a scam i ask the guy for his info where they were at and such but he wouldnt tell me and hung up he said he was from a lawfirm but said it so fast i didnt get it so i ask again he said cant u understand english lol
I Recieved a text message from an Indian male sayin his name was Tim MacIntosh and it said that tomorrow that if i did not pay them the money that i owed that i will be arrested. I looked up all the the information while I was on the phone with this male and all of it said that it was a scam..when i asked the male Tim about it he started getting mad then asked how i can speak to a federal officer like that i then asked him for his badge number the he started screaming at me
This scumbag calls my office non stop. I have asked him repeatedly to stop calling me at work (it is obviously a collector, however I have yet to find out what for..he just likes to harass people) and to please contact me at home. He has probably called about 150 times in the last month, on one day went as far as to hit redial every time I hung up on him for hours, tying up the business lines. I called our local police (this man identified himself as police, and obviously he is not...that's a crime) They contacted him, it stopped for a while and now he's at it again. My boss called him back. Politely asked him for his legal department/supervisor to obtain an address so that we could send legal correspondance and he told me "he was from mars" "call back tomorrow" "you're breaking up"
If anyone knows who this is, could you please help me in getting a name/address anything. I am goint to get fired over this jerk.
