They are in violation of multiple aspects of the Fair Debt Collection Practices Act with the statements they made to you and it is doubtful they have any ability to sue you in court. If, or more likely, when they call back keep demanding written proof of the debt and proof they have a legal right to collect that debt in your state sent via US Mail as required by the above law. Do not acknowledge that you owe the debt over the phone. You can also remind them that federal law requires they send you the required proof within 5 days of initial contact. Keep logs of dates and times of calls and the content of the call, it could come in handy later if you decide to pursue action against them for FDCPA violations.
I have been harrassed by the same scam, and they are relentless!!!! I called the civil court clerk and indeed this is a scam. Even though I know they are a scam and I was told to report them to the Attorney General it is still beginning to wear on my nerves, and they are contacting family members and scaring them to, telling them that I have a civil suit against me. First I got harrassed by an 800 number and now the 347 number is calling my family members and tryiny to get my address. They do a good job of pretending to be legitimate and scared the crap out of me at first, but a few follow up phone calls straight to the offices they claim to be calling from and I discovered they are FRAUD. EVEN HAD A FAKE CASE NUMBER. The harrassment is getting old. I just have to let you know I am dealing with the same scam I know how irritating it is.
Its not really the civil division don't worry. If you need peace of mind just look up the actual civil court in the county they claim to be calling from to confirm. They will tell you its a scam
Has anyone on here every been served theses so called papers, or have someone show up at your work? It is getting scary with these calls and do not know which way to turn anymore. I feel like I should just give them what they want, and that way the can stop calling. Its a PAIN!!!!
Even if you pay them the call will not stop, I have been getting this type of call for 3 years since I filed bankruptcy, and have never been served or mailed anything. They are looking for a quick buck, if they get $ out of you they will try again with you at a later date. If you have any conserns call your county clerk and explain what is going on, they will most likely tell you it's a scam. Be sure to report all calls to the FTC and you state attorney general.
JUST IGNORE THESE IDIORS!! THET ARE VIOLATING FDCPA AND ALL LAWS POSSIBLE ABD THEY WILL BE CAUGHT AND PROSECUTED TO THE FULL EXTENT. IN THE USA AMERICANS CAN NOT BE JAILED OR THREATENED FOR DEBT. This is why we have US BANKRUPTCY PROTECTION LAWS IN PLACE AND ANYONE HARRASING YOU WITH [***] LEGAL JARGON NOT IN WRITING IS JUST A LOW LIFE TRYING TO USE SCARE TACTICS TO PREY ON LESS KNOWLEDGEABLE PEOPLE. Just ignore these fools and keep REPORTING THEM TO THE LOCAL AND NATIONAL AUTHORITIES SUCH AS DISTRICT AND STATE ATTORNEY GENERALS AND FBI. They will be stopped!! Trust
