SCAM SCAM SCAM.....This place has called my cell, my wife's cell and my father's house, saying I received a payday loan on Christmas day in 2012. I was spending Christmas with my family! it is supposedly from Three years ago! Yesterday when the man called he sounded like a little kid, and when I got rude with him he hung up on me. Today a different man I talked to threatened me saying he would file with local courts and I could have my day in court. I told him that's just fine,I have records from US Bank showing I didn't even have an account with them in 2012, and to be ready for a counter suit to be filed on them for harassment, and the so called LENDER that says they loaned me money. They steal your info from internet and use it to scare u into thinking you really do owe money, hoping to trick you into giving them money for a bill you never had.
I received several calls from this company using the Hagan and Berman, Barnes and Thornburg Associate and Rubuen and Berman. When you let them know you contacted the law office they are using they use another law firm number. I spoke with both attorney offices and they never heard of them and they are getting calls from individuals each day about these calls. I reported them to the better business bureau and the state attorney office in California. The problem with people they hide behind cells numbers and they are untraceable. They go back to 2011 hoping you can't remember back that far and make you think you owe. The sad part some people has giving them their debt cards, credit cards and money to pay a loan they never had. I hope they catch these people and put them out of business.
It seems these criminals are using the names of actual law firms to extort money from people. From the website of Barnes & Thornburg:
Fraudulent Solicitation
Scam Notice
Barnes & Thornburg LLP urges consumers to avoid fraudulent money collection scams using the Barnes & Thornburg name or names similar to it. Barnes & Thornburg LLP is a law firm, it is not a collection agency and it does not directly contact consumer debtors demanding immediate payment of money. Any such uses of the name, or names similar to, “Barnes & Thornburg” in this setting are unauthorized and fraudulent. Consumer debtors who receive these calls should exercise extreme caution and seek their own legal advice or contact law enforcement.
This is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, etc. all for an alleged or nonexistent debt.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/
