I did do a pay day loan also in 2007 and have since been trying to end meet and clean up my credit so when I received a call threatening to garnish my wages i freaked out and made a payment plan. After making the first payment my car broke down and was unable to make the 2nd agreed payment to bring down the $1300 balance. Now they are hounding my work and my cell phone. After explaining my situation and asking them to wait 2 weeks she began threatening to garnish me. So at this point I am irrate and want to know if a payday loan provider can take the legal recourse to threaten and garnish your wages.
I have been reading the posts and if this is not a valid firm or process I am ready to give them a taste of their own medicine!!
these people say you owe money dont they know you have to have a bill set to you before any one can take you to court sounds like a collection scam to me
This place has called my husband's phone from a 716-986-9606 and a 888-266-7848, her name is Ms. Jones as she tells my husband while talking about her personal life, yet trying to collect a bill(how professional is that)? They told my husband that he had written a bad check for 2.00 a while back and that he now owes over 500.00 on it and to send 93.00 per week until Feb. 2011. My husband, before informing me, sent them 93.00 through a "add money" card. Thank God he didn't give them his debit or checking numbers. Me being the wife that I am and business savvy; listened to the voicemails that this Shapiro & Price were leaveing for my husband and it sounded very unprofessional and on calling these numbers back after hours, their voicemail even sounded like a gimic, they didn't even have the intelligence to update their voicemail to a January message, they were still speaking on December 2010. I informed my husband that any professional and legit debt collector would help in finding ways to have your debt paid at his convenience, as long as it gets paid and they would not be stateing that they are putting out a warrant for his arrest and taking him to court...for they are not the law. Last time I checked, the only title that could put out a warrant for an arrest is a Judge. Police officers also have to get permission from a Judge in order to send a warrant out for anyone arrest. I then told my husband that if he supposably wrote a 2.00 check, that isn't even in the state in which we reside, that he should demand a copy of said check to be sent to him and contact the bank at which Shapiro & Price stated the checks account. After receiveing more and more harassing calls, I finally googled the name Shapiro & Price and read nothing but terrible reviews and that they are fraudulent, just as I had been telling my husband. These crooked people also went as far as calling my mother-in-law and having her scared out of her mind that her son was going to jail over 2.00 check. They may have gotten over on us for 93.00, due to my husband not wanting to have to go to court over and the fact that he hates drama, but with his wife and best friend by his side, they will not get anything else. And plus, we use plastic or cash, not paper checks. And I cannot wait for them to call again, because I, the Mrs. will be letting them know that we do have a family attorney and if they call again, we will sue for defamation of character, phone harassment and fraud. I wonder where they are getting their names and information from? We live in Texas and we don't play that....yippie ki aye you ignorant losers. I hope Ms. Jones knows who she is working for. It is a scam and they definitely picked the wrong one this time.
They call from a number located in Buffalo, New York, however, if you do a reverse search under this number, there isn't an address...but it does state that it is a land-line phone number. If they call and you donot answer, they leave you a message that clearly sounds like it is recorded on an non-business answering machine. And the woman has the nerve to say, "if you know your parties extension, please dial it now". Lol, they have never given us an extension in regards to contacting them back. If you call them after hours, they have some lady who hesitates to even leave a message and is still talking about the month of December 2010 and we are now in January 2011. And any debt that is to be collected by a real collector; will find your current address and mail you an invoice for it, showing you the amount and what the debt is for. This Shapiro & Price want you pay by a pay card or give them your account numbers. And usually when you get a call from a collection agency, they donot say, "my name is Ms. Jones"....Ms. Jones can be anybody....they never or hardly give a last name, they usually say, "hello, my name is Natalie and I am calling from ?, is ? available? This Ms. Jones lady was very ignorant and unintelligent, she was telling us about how she knows people and has family all in Tennessee and she even stated this, "boy you had me looking all over for you, calling your momma and stuff". What debt collector talks like that and what debt collector would care about telling you their personal information when their sole reason for calling, is to collect a debt? I know five year olds that can speak better, handle themselves better and could do a better job at sounding professional than these snakes.
I am contacting the Attorney General, calling and making a statement with our local police department so that they can contact the proper authorities in Buffalo, New York...I am calling the BBB, NSA, NAACP, Internal Affairs, Internal Revenue, Local and worldwide news stations to make them aware and help put the word out, facebook, myspace to advertise about these crooks....the numbers at which they are calling people from can be traced and we have enough satellites in the world to have every camera near that area working to catch these people. I have recorded their voicemail and messages to my recorder that they have left us and on our phone. We are sueing them for our money, harassing us and making threats (phone harassment), for calling other people about us and giving false information (defamation of character) in order to get information about us and this is a promise....because intelligent adults don't make threats, we make promises. It is time that someone makes them feel unempowered. We have families and other responsibilities to take care of and when our hard working money is going toward these idiots, our children and our important matters suffer to an extent. Our money could have went toward a real bill, gas in our car, extra clothing or something meaningful, rather than going to nothing. When you mess with my family or my money, then you have created a problem. They should be called [***] & Pimps or Snakes & Pigs or [***] & Piss...just my opinion and the names do fit. Game on!
This lady called from Buffalo NY from 716-986-9606. Then mumbled her name and said from the claims office of Spario and Price. Stating they had a warrent out for my husband and needed to call them back immed. Since he is on leave for a severe med problem, I called them. She said that there was a warrent in my county for my husbands arrest for a Pay day loan from 2006. We owe that, I know. But when we asked her what county had the warent out for my husband, she couldn't tell me. I asked to recieve a copy of the bill to set up payment arragngments, and she said no, only through phone and bank account {red flag went up} Then I said I want to validate the warrent through my cousins husband who is a county sheriff, thats when she cussed me out and hung up. I talked to my cousins husband and he said they can't do that, its a civil matter, and since they did not say, "this is an attempt to collect a debt, and any info will be used for that purpose," then AUTOMATICALLY its a SCAM, by law, they have to say that.....don't give these fools the time of day, I filed a complaint against them...we'll see if they call back!
