I do NOT have a debt with BOA but rather with Wachovia/Wells Fargo.I do have a checking account with BOA but nothing is owed to them by me. Is htere any connection?
A man called and asked if knew a specific person. I did and he asked me if I had his phone #. This person was from Bank of America and was looking for someone with the same last name as mine. I am a BOA customer and they used my file to contact me for information on someone else. As I thought of this I told him he was calling an unlisted # and promply hung up. Is it legal for a bank to call its customers to find other people that they are looking for.
I consider this an invasion of privacy and they don`t care of the privacy of their customers if they let their own people use private information for their own use.
You are WRONG are you deliberately trying to confuse people or are you just terminally stupid? Virtually all loan agreements (that's CONTRACTS to you) contain a clause that permits the creditor to ASSIGN the the debt to someone else.
While this IN NOW WAY excuses crooked collection agencies who violate the FDCPA, the assignment itself is almost certainly legal according to the terms of the original CONTRACT.

I just got a call on my cell phone from this number, from a woman looking for someone with my last name. When I told her that I wasn't that person, she implied I was lying, and wanted to know who I was if I wasn't the person she was looking for. I said "I don't know, you called me, who am I?" and hung up. I have never heard of the person she was looking for.
They called me (too early) yesterday morning looking for my brother-in-law and/or his soon to be ex-wife. They left a message asking me to call back-- no way am I getting involved in my deadbeat in-laws' financial troubles. Their phones have been turned off and the house is in foreclosure, so good luck to BofA trying to get anything out of them. This is the third company that's called me trying to get them, so he must have used our name as a contact way back when they were living high on the hog.
