Everyone I know can get intouch with me...My wife was at a upstairs phone and couldnt see the id...We never answer phone if we dont know the number except this one time..Smells fishy and [***] to me
I received a call from this number today. They first said my last name with the first letter wrong. I explained that my name is not spelled that way and they must have the wrong person. They then went on and said that a company made a complaint against the person with my phone number and gave me this number to call (888) 244-0560 and gave me a case number to give them when they answered. I said you must have the wrong person but agreed to call the number. They then had me read out the number and case number. I told them I would call to sort out the mistake. I then hung up and Google the number and found all this info.
See my reply to you above - You have NO responsibility in this matter. There is nothing to sort out. These are professional crooks and there is no truth to anything they told you.
I have never heard of a complaint or summons being served via phone. I am assuming that this is a debt collector or some form of scam artist. Get the callers name, company they represent and an address and phone number where they can be contacted. Not the number on the caller ID those are usually unreachable. If you determine that it is a harassment call or solicitor ask them to stop calling and send them a letter requesting same. If they continue after that you may take action and get paid by them each time they call. Remember what you consider harassment may not be if you owe money. It is best to check with an attorney what your options are as I am not an attorney. This message is hearsay and should be treated as such. .
"I have never heard of a complaint or summons being served via phone." That is because it is not legal to do so, except in the mind of a criminal who is trying to extort money from you. "Get the callers name, company they represent and an address and phone number where they can be contacted. " Good luck getting the truth out of them. Federal law already requires them to do this:
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
"If they continue after that you may take action and get paid by them each time they call. " Sorry but the FDCPA is a once and done deal, not per call. However, with a good lawyer the settlement could be substantial. "Remember what you consider harassment may not be if you owe money. " Doesn't matter if you owe or not, if they violate the law, then it is illegal and if you need to counter sue them you will win.
