These people are calling me and are very rude. Im calling the better business bureau today sadly to say I owea verizon bill and want to pay it due to me being out of work. I even gave them my bank information and they lied about receiving a payment I have there names.
Hi all,
I had a collector with "law firm" in their title try to sue me. I got a letter in the mail saying I was being sued! I went to the sheriff's office and picked up the papers. I ignored this third-party collectors previous letters because I knew they didn't own the charged off account. These people buy bad debt for pennies!
I headed over to a local lawyer who does consumer law. She typed up a letter and a few other documents asking them to prove to the court they "owned" this account.
Guess what? They lost the case. They couldn't verify. They didn't count on me spending a little money to fight back.
Most of these companies back off immediately if you just hire a lawyer to send out a letter asking them to "verify" they own the account. They won't count on you having legal representation. Do this before you get sued! Do it as soon as you get correspondence from these collectors that buy old debt for pennies! They're just trying to make money. In most cases, it would only cost you about $60. Well worth it to me - to not get harassed daily.
If I Believe A Debt Collector Has Violated The Law, What Can I Do?
You have the right to sue in a state or federal court within one year from the date
the law was violated. You may recover money for the damages you suffered
including emotional stress. Also you can sue for statutory damages up to $1000 if
you prove a violation under the law. Finally, court costs and attorney's fees can be
recovered. A group of people also may sue a debt collector and recover money for
damages.
Tell them you will record the phone call and they wil stop immediatley.
