UPDATE: I took the call from them at 8 a.m. this morning and played into their game to get as much info as possible. They are reading from scripts, and if you ask them anything that goes off-script, they transfer you. I spoke to 3 people this morning: Louis Wilson, Heather Lawson and Ben Foster. In looking up Heather Lawson, I see complaints about this scam dating back to 2006!! Why can't we stop this?! This personal information should not be released when people apply for a payday loan.
When I asked for an address, they gave me 42 Broadway 5th Floor NY, NY 10004, and said they are the DCA Law Firm - Department of Corporate Affairs. In actuality, there IS a DCA at this address, but it is the NYC Department of Consumer Affairs.
When "Ben Foster" no longer felt like making up stories to answer my questions (such as "If this was in collections, why haven't I received a written notice within 5 days of initial contact, as per the law under the Fair Debt Collection Practices Act (FDCPA)?"), he said they would go ahead and process my file and we could deal with it at the courthouse on Monday. I sweetly answered "Oh yes, let's go ahead and do that." He was a bit surprised and then asked for my attorney's info, so I said "Yes, he definitely wants to talk to you" and gave him the info. Then I told him that we were aware this is a scam, that I have already reported him to the FTC and FBI, and that all calls were being recorded. I told him to never ever call here again or he would be the one showing up at the courthouse. I hung up. No callback yet. I am sick to my stomach with what these people are doing to scared, financially-strapped people.
I also just got a call at work today with a very heavy accent (a man) I couldn't understand him and told him to slow down. He said that I have a lawsuit against me and it will be filed on Monday and if I don't pay $1,195.00 it will cost me 5,000.00. I told him not to call me at work so I hung up and he kept callin me..his number showed 0000?? So when he called for the third time I told him I wanted to talk with his supervisor and this lady name Rachel Jonathan came on the line and she also had a accent. So I told her to give me her # and I will call back. The number is (New York) 646-626-6118. She wouldn't give me a case# or the Cash Partners of Americas #. She also told me that they will contact my work and talk to my boss which I told her to go ahead. I also told her why I haven't received any letters from the attorney or calls. She stated that they only will contact me by email and that I probably deleted them thinking it was a spam. But she did mention to me my bank name which was correct and that's when I wanted to check how she got that info. She also stated that I have three counts against me, check fraud, and so on....I hope this is a SCAM!
Scam!! I am an attorney and they called my husband trying to assert that he was being sued for a payday loan taken online back in 2009. First of all, that is crap because my husband would rather chew off his arm than take a payday loan. Second of all when I inquired about the identity of the original debtor and the date of the alleged transaction, they persisted that they did not need to have the information handy now and it would all be in the court papers that I would see tomorrow "in court". Lastly, they kept saying that there was an Affidavit suing him and that he had a court date tomorrow. When I began to explain to them how the legal process works and proper service of legal documents, they quickly hung up on me and never called again.
Please do not let them bully you. They are foreigners, not professional at all and have no legal knowledge. I also agree with the other posts in that the name of the alleged law firm is ridiculous and does not exist in NY or any other state. I am on a mission now to spread the word about this scam.
I just received a call from a 0000 number with "Nick Williams" saying Cash Partners of America was suing me for $540.87 and that I would be picked up to go to court the next day. He added that if I did not appear in court or was found guilty I would have to pay a $5000 fine. Needless to say, I was pissed off and kept asking for a reference number or website that I could go to to prove the legitimacy of the claim, and "Nick" continuously avoided answering. Eventually, I just told him that if it WAS real, I would rather go to court and explain why I didn't pay immediately the be out $500 to a scam.
DO NOT PAY THIS COMPANY. First of all, if someone with a heavy Middle Eastern accent is calling himself "Nick Williams", you should already be skeptical. But then if you can't find Cash Partners of America through Google (and you CAN'T), tell him to go [***] himself and then hang up. It's [***] that there are [***] out there who get paid from stealing other people's money, but hopefully this site will help.
Just got a call from this number saying that a lawsuit was being filed against my name and social security number (the woman spoke with a heavy indian accent so I did not understand most of it). She left me a number to call her back on, which is 949-205-4009. When I call the number nobody answers.
