Your post sounds really stupid.  "Intent to bounce".  I'm going to be laughing at that all day.  

Just so you know...  Anytime you write a check with the intention to honor it in the future the check becomes a promisory note.  There is no criminal intent.

As far as a company running a check usually twice is BS also.  Most companies today get the information off a check and do what is called an ACH.  The company can present that to the bank as many times as they want to.  I had one client who had to close her account because the company would not stop presenting the ACH.

Ok when someone does a payday loan they write a postdated check to pay for money upfront. If the lender tries to cash that check before the day agreed upon they are violating the payday loan contract. Payday loans are just like pawn shop scams. But just like in the pawn shop, they cant sell your stuff or cash your check before the day it is due. Otherwise you can sue them for contract violation. When some dumb payday loan company sells it to an even stupider collection agency it gets worse.

Most states do have bad check laws. But if you can show that you had the intent to pay by acct balance or expected deposits then there is no INTENT to defraud. These collectors like to threaten you with arrest. Not only is that against FDCPA law but it is also extremely unlikely to happen since 9 times out of 10 the collector is not even in your state. Unless you are writing very large bogus checks then nothing will happen.
Remember there is no intent to defraud if you reasonably thought you would have the money to cover it. If you wrote a check for $10,000 when you only had $2000 in your acct then you are guilty of fraud. If you wrote a check for $500 and had $450 in your acct but were expecting a deposit soon then you are not guilty. Screw these bottom-feeding jerks!!!

Rick I think you are a liar also.  Why would you defend the actions of a collection agency if you didn't have an interest in it?  Your hiding period.  Besides you tell one person on this board you don't think he is acting responsible.  However, you indicated in your own post that you got a message from this company.  If you are so responsible why did this company have to call you and leave a message?  If you are so responsible why didn't you pay your obligation before it got turned over to this collection agency?  You need to proof read what you write before you post it.  Anybody reading your post should know right away you are either blowing smoke or in fact you are a liar.

It's funny actually. I checked my credit report recently and I had this agency called NCO buy some debt from a hospital that took me in from food poisoning. Turned out that my insurance didn't pay all of it. It was a huge headache. Dealing with an agency can be hard but you just have to ask them for the proof and be consistent. I paid them and made sure they billed me the receipt. Plus it will help your credit score. The reason I did it.

First of all, Mary... no one is perfect. this is the ONLY time something like this has happened to me. I never said I was responsible and everyone else should be like me. the rest of the people didnt sound as retarded as JIM, thats why i chose to single him out. im not specifically defending the collections agency i am simply discussing the principle of paying a DEBT.

this was from 2005 and i moved because i got divorced, if you must know, and things became complicated with my prior obligations. these things happen. but hey, i owed money, and i paid it. AFTER making SURE this company was legitimate. i wasnt threatened at all, they simply explained everything and i knew immediately i was in the wrong. i asked for their credentials and called back with a payment.

and thanks for the advice, but no need to proof read anything.
