I have been getting phone calls from Sam Wise at Hamilton Burke Associates, asking for Janet Kelly. I keep telling him I do not know her, nor have I ever known her. He promises to remove my name from his list, but next week, there he is again. I finally filed a complaint with the Wisconsin Department of Agriculture, Trade, and Consumer Protection. They handle all sorts of business telephone abuse issues in our state. Other states often have somebody in their office of the Attorney General. I suggest you file a complaint and let the authorities have a wack at Hamilton Burke, Associates. My guess is that is your best chance of getting those louses to stop calling.
you need to check the statute of limitations in your state. After a period of time all you have to do is write a cease and desist letter to the collection agency and they can no longer legally contact you. All states have a statute. Texas is 4 years for credit cards. This was from my divorce over ten years ago. All this time I paid cash for everything - just bought a house now and engagement ring and this is how they found me. It started all over again. They bought the old debt and anything collected goes directly to them as the credit card company wrote the bill off. It was so old nothing showed up on my credit when buying my house. My only phone is my work cell phone, paid for by my company, and they keep calling me on it so I wrote my letter. Just sent it certified - return receipt. Had to do this on another company last year and the calls stopped.
And if they try any funny business, log the calls, keep receipts for certified letters, etc., and get a consumer attorney. You may be able to sue THEM for violating the Federal Debt Collection laws.
This company continues to call the business I work for. When I tell them the girl they are looking for no longer works here they seem to accept that but then they keep calling. I keep telling them to remove my number...but that doesn't seem to work of course.
Some how this company got their hands on my cell number and they won't stop calling me. I am not the person they are looking for but I guess they are too stupid to realize there are laws to prevent them from bothering me. I contacted the State Attorney General and the FTC as well as an attorney. It is scum like this that gives collection agencies a bad name. I will just continue to ignore their calls until they stop or I sue the hell out of them.
