I was contacted by a BrIan McLean regarding a payday loan he claims I defaulted on thru ACE Cash express. I have also spoken with a supervisor there by the name of Ron Kissler 716-504-6908 and a Tom. They have called friends and family members claiming to be from a law firm looking for me regarding a legal matter that they need my statement on. I spoke with them and they have threatened to have me arrested for bank fraud. They would only email proof of the debt. I made a payment arrangement with them out of fear. They claim I owe over $1000 to their client. I made arrangements for a payment of $115 to come out approx. 20 days from the date of the call. They took the payment out 3 days later, wouldn't return my calls and claimed they were out of the office when they did finally call back. They claimed it would take 21 days to get the money refunded and it would be past my anticipated payment date so I should just let them go ahead and keep the payment they already collected. I have since cancelled the debit card used, notified my bank and disputed the charge with my bank. I was also contacted by another company a month prior claiming to represent the same ACE Cash Express. I had made a prior payment arrangement with them before being contacted by this firm. The first company did not send written proof of the debt either. I have checked my credit and none of these show up as collections on my credit report. I have been trying to clean up old collections on my credit to raise my score.

1. Emailed "proof of debt" is legally insufficient (See below for more info)
2. Any payment you made with them will probably not restore your credit rating, but might show the debt as "paid".
The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
* Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed ... not emailed or texted]

Tom called my parents house looking for me about a payday loan i took out almost 2 yrs ago. My loving father, being the concerned parent that he is, took it upon himself to give Tom his account info after settling my supposed debt for half of what i owe. I happened to stop by my parents house later that day when my dad mentioned it to me. I told him that i don't owe any money for a payday loan and he should not have given his account info out. (Bless his heart) I told him it is illegal for any company to give out personal info without my authorization, that should have been his first red flag, second if you can't give me the name of the company you work for or who i owe, don't expect anything from me, third, I'm going to need that info mailed to me. I love my dad and his intentions were good. Now, i need to know how to press charges on Tom for trying to scam my father.
I was contacted by a guy named Brian from this number.. it was a collections call in which he did make to me at work so I wasnt very happy at first but I gave the guy the time of day and he was actually able to help me resolve an old visa card account i had back in 2012. I owed about $4000 and mr brian was able to get me a greatly reduced settlement of about $2000! These guys arent terrible. They have a job to do much like we ourselves do in our own lives. We wouldnt have to deal with them if we paid our bills in the first place. I know the calls are legit from this # because after i made my payment i was provided with documentation via email and to my home address. As far as threats of being arrested i never heard such a thing. Mr Brian was very polite and worked with me because I was willing to work with him. Be fair people and remember.. these collectors that call us didnt put us in debt they are trying to help get us out!
