I received a call also, telling me I would be arrested at work, but since this was my "first offense" they would be willing to settle if I paid them before 2 pm, if not they were going to file in my county courthouse before 4pm that day. First of all they weren't going to file anything that day, it was Dr. King's birthday and courts were closed, secondly you can not be arrested for failure to pay a debt. When I told Mr. Johnson this he got very angry and told me that this was considered a "bad check" and that is why I would be arrested. I explained to him that in Missouri it is NOT considered a bad check, just a defaulted loan and is a civil matter and that I would be reporting him to the FTC and to the State of Florida Division of Finance, he hung up and I haven't heard from him since. The person that wrote the comment about them being "real" must work for them, They have only been in business under this name since Oct. of 2008 and have over 300 complaints filed against them already.
Christi, you may have been in jail, but it was NOT because of a bad debt, especially a bad payday loan. I talked to someone at our Div. of Finance and he told me that if the internet company I received the payday loan from was not licensed to do business in the state of Missouri they would not be able to do anything, including sue me in civil court. I checked with my lawyer and he told me the same thing saying that is why they tend to use collection companies such as this one to scare people into paying.
Also, to the best of my knowledge and from everything I could find out, Social Security is exempt from garnishments.
Nowhere can I find any "new law" about garnishing SSI. If there is such a law I'd like to see a link to it. The only way I know that even a small part of your SSI can be garnished is for back taxes or child support. This appears to be another illegal scare tactic used by bill collectors.
I received a voice mail from Eric Lloyd who claimed to work for the Law Offices of H & T, said that I would be served and left a number for a call back. I called back and notified Mr. Lloyd that I'm stationed in Afghanistan and would LOVE to come visit him at his office with some of the heavy ordinance that I'm using right now to blow up terrorists bent on hurting US. I then went into detail on how I would gut him like a fish if he continued to harass me. HE apologized to ME and hung up. Screw these people.
