After being contacted by this agency and disputing the debt owed by my ex-husband, MCA proceeded to file a law suit against me and contact my employer to garnish my wages. I called MCA and left a message about my "case" through merchant credit (MCA). The person who returned my call was insulting and rude after I asked if I could write a check for the full judgment to stop the garnishment. . I have not been served the summons, only my employer. Months ago, I contact them after the first letter and asked for my rights under the FDCPA and was answered back with a threat for a lawsuit. I was told at that time if I was a day late on the payment, I he was going to file a lawsuit. After I told him I was disputing the debt as I had months before, he hung up on me. I attempted to make arrangements for payment, the collector refused my offer and said, "we don't settle or negotiate payments." at which time he said I had three days to pay or they were going to “sue me”. I tried twice to call them back to get the log in information and was hung up on twice by a "gentleman" named "Mark" after I refused to give him access to my bank account including account number and security code. So here is the final straw, two days ago, I got ANOTHER notice from MCA for two bills; $17 and $56 dollars. One from May 2011 and one from June 2011. The notice told me they were taking action against me (again). One bill was from Alegent Heath (hospital) which I knowingly paid months ago and I have a duplicate check to prove it and the hospital was able to confirm receipt of payment. Mind you, the timeline on these events is within the same month.
Seems like they are hunting a system for anything late. Is this what I get for settling the last suit? The sell my name and now I am getting calls and junk from my ex-husbands collectors, law offices, and people who don’t even know my name with foreign accents. Not to mention the CONSTANT mail (2-4 per day) from Law Offices in they are interested in representing me. Do they have the right to sell my name to these bottom feeders? Really? A lawsuit for less than $80 most of which was already paid?
