Section 806 prohibits a debt collector from any conduct that would "harass, oppress, or abuse any person in connection with the collection of a debt." It provides six examples of harassment or abuse, section 806 (1) - 806 (6) below.

2. Unnecessary calls to third parties. A debt collector may not leave telephone messages with neighbors when the debt collector knows the consumer's name and telephone number and could have reached him directly.
They many now be liable to you for statutory dmages up to $1000 for breaking the law.
Also, for those who continue to receive phone calls, this is considered harassment.
Section 806(5) prohibits contacting the consumer by telephone "repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number."
1. Multiple phone calls. "Continuously" means making a series of telephone calls, one right after the other. "Repeatedly" means calling with excessive frequency under the circumstances.
It's time to put these bottom feeders out of a job and back into prison.

I was getting calls from this company for a former roommate, about a credit card he never had. They since have started calling me about a 15 year old debt supposedly mine. I told them I had no idea what they were talking about and to send me something so I could dispute it. The guy told me well, I can see from your credit that you pay your bills on time. Just fill out the form we send you. They sent me a letter with a form for identify theft. I just sent them the classic 'debt dispute' letter, with delivery signature confirmation. That was two months ago, and I just got a call today from (407) 347-4014. I didn't answer. No message was left. This debt is time barred, past the SOL, and hasn't shown up on my credit report since before 2006. So... Assuming they keep calling (ha ha), next is a cease and desist letter. Creepy that they actually had my info. So they truly are buying old, time-barred debts, long since written off by the lender. Good news? Cease and desist means they have to stop calling or face legal action, time-barred past SOL debt means they can't take legal action against me. If they do, we give the judge the statute of limitations which we've passed almost three times over.
Portfolio Recovery has been harassing me for over a year. They have a "name" - first initial and last name with my phone number (identity theft? - or they just saw I had the same initial and last name in the phone book). I've politely tried to tell them that they have the wrong person. They ASSUME I must be related to this "name" - it's a very common name. Then they want all MY personal info to verify they have the wrong name - Yeah, like I'm that stupid! I've screamed at them to stop calling. I'm to the point of changing my number and paying an extra $15/month for an unlisted number. These people are nothing more than bottom-feeding scum.
