Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I just got a call from Daniel Slane Assoc. at work stating that I have an unpaid loan with Cash Central and yes I do have one, I just couldnt afford to pay it back I wasnt trying to be malicious...he said he ran my criminal record and he I had no history (I knew that) and I havent seen anything in the mail that I am being sued, he said that he goes to court tomorrow and just couldnt see charging me 1800 in attorney fees..now i could probably afford to pay this on amount owed ($214.00) but I amfraid to give them by bank info, any suggestions or is this a legit thing
Anyone using the tactics that are described are not legitimate. Companies with good reputations do not have collectors pose as investigators or process servers or the police. Slane Law is in my city and if they are conducting business in this manner they will not be in business for much longer.
I am in the debt buying industry and hate to hear of these practices.
Retain a consumer protection attorney and make them pay you. What they have said is against the Fair Debt Collection Practices Act. What creditor is going to sue over $214.00, and if they are going to sue, why would a reputable creditor use this gang of thugs to do so?
