No one gets a heads up they'll be served - the court process server just shows up, papers in hand. If your callers refuse to MAIL proof that you owe a debt and that they have the legal right to collect said debt, they are owed NOTHING, per the FDCPA. It's also illegal to threaten people with lawsuits to intimidate them into paying a debt. If you're concerned that you may actually have a lawsuit against you, call your local courts and ask them if your name is on any of the schedules. Call your local police - they'll even tell you this is not how the system works.
Advise the callers that you're recording all calls they make to you so your own lawyer (even if you don't have one) can file a lawsuit against them for multiple violations of the FDCPA. Report the calls to the FTC, the FBI, the Dept of Justice and your state's Attorney General.
Received a call from this number saying to call back before they send summons to house and/or work. Left no name and company name on message. Just claiming that it was from a Process and Summons Division and to call 701-491-7809. I looked it up and its a number from North Dakota. I live in Ohio. Really??? And when I called the number back I got a voicemail from audix.
Also just got a robo-call from someone saying they were from the Process & Summons Division, but didn't day from what. We are on vacation now and this worries us abit. Last time we travelled a few months ago our credit cards were electronically charged to some accounts in Santa Domingo. Hope this is not the tip of the iceberg for another scam.
Received a call today, along with a call at my parents house from someone using my maiden name saying they were from the process and summons division and had fraudulant activity reported on my name and social security number. They said I needed to call this number immediately before I received a summons at my home or work. Really!!!!!!!! When I tried to call them back it goes to a answering machine with no name attached and does not allow you to leave a message. When I tried to get the number from which the call came from it says Caller withheld their identity. This is a Scam>>>>>>>>>>>>>
This EXACT same thing happened to me today. Think about this. If you committed fraud, do you think the police will call you and warn you that you are going to be arrested? I think not and I should know. I'm a paralegal and my son is a cop. THIS IS TOTALLY A SCAM!!!! Do not give these people any information, just tell them you will report them to the police and hang up!
I have received the same call but on my husband's number using my maiden name. I was about to contact them and seeing these posts calms me that this is a scam.
