A legitimate debt collection company would not hang up on you for requesting an address. There's no such thing as a restraining order involving a debt. It is against the law to threaten you, as this employee did. Verify that you really have an unpaid debt by contacting Bank of America AND checking your credit reports from the three credit reporting companies (in case there's erroneous info on them that needs to be corrected). Also, check the statute of limitations for debts in your state; you're already more than 7 years past the alleged unpaid debt. It's possible that your state has laws to get a debt that old expunged from your records -- and that's assuming you really did owe it in the first place. If, indeed, the claims about a 2003 debt are false, or if they're trying to coerce you into paying a debt that's past the statute of limitations for your state, it's in your best interests to file a report against Litigation Support Services with the Federal Trade Commission (FTC).
usually what happens is if you provide the company with that information they will just mark that the debt is already paid, legal action should not be pursued and move on, I would just call them with my proof of payment information or offer to email that to them.
I was called today and told I was a respondent in a litigation affidavit #GBK1552 I have been trying to look up this affidavit # online but cannot find any way to do so. I found this post and when I tried to call the number back all I got was a automated service. When choosing the closest option to why I was calling I was on hold for 40mins. Not sure I'll call back if they are suing me for a past due bill they will find that they are out of luck as I filed bankruptcy and it has cleared.. If I get ahold of them and find out anything more I will be sure to update my post.
Well we have received this call too. Did not answer it, so they called back several times a day for weeks. Always telling the same story. You do not respond, you will be arrested in 24 hours. Nobody came out to arrest anyone. This sounds like the scam from NCO we had received about 4 years ago.
NCO sent me a letter demanding 6789.13 for a credit card that was reported as not paid 15 years ago.
With interest the bill totaled up to be just at 14,000.00. NCO stated in the letter that they would give me a break if I paid in the next 10 days. Instead of 14,000.00 they would accept three equal payment of 6789.13 over the next 3 months. To agree, just send a check for the 6789.13 and then payments would be accepted. Notice that 6789.13 X 3 =20367.39 Such a deal right?
I spent 3 weeks researching this, calling credit card companies whom they said the card was from.
No such card ever issued, ever issued. Even the credit card co said this was a scam.
This may be a NCO affiliate or subcontractor.
They get an address or other information off of the web and make up everything else. Tell you that you owe the money and many people just send it in. They make hundreds of millions each year using this scam.
However if you should owe the money, do contact the original owner of the debt incurred and work with them directly. Never give a promise of payment on the phone. Know your rights and use them. Keep everything on paper.
This same number called my moms house and left a message. so i called them and they said all that same stuff. im really scared that its real and i dont want to go to jail. they wanted to settle it with me or have a sherriff deliver me a sepena to go to court. they said they are sueing me over a credit card and trying to get me for fraud, saying i took the money and ran. i rember the credit card(or at least applying), but i thought i was denied, but honestly i dont remmber. im just so scared. i didnt think this could happen over a credit card, i know it goes on your credit report and to collection agencies but i didnt think u could get in this much trouble. someone please help me figure this out. thanks
